Fulcrum Audio is a division of Markham-based Cerebrous Inc., a wholly-owned subsidiary of Cerebrous Inc.

Fulcrum Audio ("We"/ “Us” / “we” / “us”) believe that the user’s (“You”/ “you”) personal information deserves protection and we subscribe to the privacy principles set out in the Government of Canada's Personal Information Protection and Electronic Documents Act. All references to “Web Site/s” or “Website/s” in this Privacy Policy mean www.FulcrumAudio.ca or other Fulcrum Audio provided web sites. This Privacy Policy describes our practices regarding the collection, use and sharing of your personal information. By using our Website, you consent and agree to the collection, use and disclosure of personal information and to the privacy practices set out in this Privacy Policy. Fulcrum Audio expressly reserves the right to change this Privacy Policy at any time.

This Privacy Policy applies to our retail stores, our Web Site, and all other channels in which Fulcrum Audio collects and uses your personal information

This Privacy Policy tells you how we use personal information collected at this Web Site. Please read this Privacy Policy before using the Web Site or submitting any personal information. Our goal is to make sure that you are totally contented with your purchase and to this end, Fulcrum Audio offers a Return Policy. For Fulcrum Audio to continue to offer our Return Policy, we ask for personal information such as your name, address, and telephone number for the purposes of detecting and preventing fraud. When functioning with our Consultants to replace goods that are covered under your insurance policy, we will need some essential information, such as your contact information, insurance claim number, and the name of your claim adjuster, so we can process your quote in a timely manner and bill your insurance company directly for you.

Following a purchase from some of our departments we may send you a follow-up letter to thank you for your business, or we may contact you to ensure that you are completely satisfied with the delivery, setup, or installation of your new product. We may use contact information collected in-store, online to conduct occasional surveys and other customer research. These surveys are entirely voluntary and you may easily decline to participate.

Our Web Sites can be browsed anonymously. However, to engage in certain special features or functions of our Web Sites, or to order products and services from our Web Sites, you may be asked to supply certain personal information, such as your name, email address, postal address, telephone number, or credit card information. Fulcrum Audio offers free newsletters, promotional e-mails and personalized on-line advertisements as a service to our customers. We will send you newsletters and e-mails periodically listing current specials and deals. From time to time, we may run contests or promotions. If you participate, you may be asked for contact information as well as additional optional survey information (for example, product preferences). Personal information from contest entries will be used only to administer the contest and contact you if you win. For research and analysis purposes, we may also summarize contest survey information in a manner that no longer identifies individual participants. All contests and promotions are subject to this Privacy Policy and the rules that will be available with each particular campaign. Fulcrum Audio may offer activation of certain products and services like cellular plans, satellite services, or Internet services. These activations may require that certain contact and financial information be collected and provided to the respective service providers as part of the activation process. For example, a cellular carrier may need to perform a credit check prior to activation so a government-issued ID number and your credit card number may be provided to the carrier for that purpose.

In some cases, we automatically collect certain information.

When using our Web Site, we may gather the Internet Protocol (IP) address of your computer, the IP address of your Internet Service Provider, the date and time you access our Web Site, the Internet address of the website from which you linked directly to our Web Site, the operating system you are using, the sections of the website you visit, the website pages read and images viewed, and the content you download from the Web Site. This information is used for administration purposes and to improve the Web Site.

We may use web beacons or pixel tags to assemble tracking information reports regarding Web Site user demographics, Web Site traffic patterns, and Web Site purchases. Fulcrum Audio and services are intended for general audiences and do not knowingly collect any personal information from children. When we collect age information, and users identify themselves as under 13, the Web Site will either block such users from providing personal information, or will seek to obtain consent from parents for the collection, use and sharing of their children's personal information. We will not knowingly ask children under the age of 13 to provide more information than is reasonably necessary to provide our services.

Please note that if you grant consent for your child to use Fulcrum Audio, this will include such general audience communication services as e-mail, instant messaging, and online groups, and your child will be able to communicate with, and disclose personal information to, other users of all ages. Parents can change or revoke the consent choices previously made, and review, edit or request the deletion of their children's personal information.

Fulcrum Audio is in the business of providing a forum for the useful exchange of information about products and services between its users. As part of providing this service, we collect and share personal information among our users in a number of ways.

When you submit a deal through our on-line form or via email, we will not post your email but will post the name you have provided with the submission. If you do not wish your name to be posted, you can indicate it in your submission or ask us to remove your name from the posting. When you email a deal to a friend, we may enter you into contests from time to time and would use your email to notify you if you are a winner.

When you post a comment on our Website, we ask you to provide your name and email address. You also have the option of providing your location and homepage address. We will moderate comments. Your comment and name will be accessible for viewing by all users of our Web Site. You also have the option of displaying your email or being notified of any response to your posting. We also provide an option for remembering your information and pre-filling it for comments on future visits.

From time to time, we may run contests for our users, in which case we would use your email to notify you if you are a winner.When you enter a contest or other promotion, we may ask you for contact information such as your name, address and e-mail address in order to administer the contest, to send you promotional e-mails, notify winners and make the winners' list publicly available pursuant to certain states' laws. Your consent to such promotional use and disclosure of this information is a condition of your participation. As a condition of receiving any prize, you will be required to submit an affidavit of eligibility, for us to ensure that you are eligible to receive the prize according to the contest rules.

In order to participate in our on-line forums, you need to create a user account by submitting a user name, email address and password. We will display your user name with your postings on the forum. You may also choose to have us display your email with your postings so that other users can contact you.

We may wish, from time to time, to post your comments or submissions as sample testimonials from our users, in which case we will ask for your permission in advance.

We may also use personal information and data collected through your emails and use of our Website to generate statistics and aggregate reports for internal use and for sharing with our affiliates and advertisers. These statistics and aggregate reports will not contain any information that could identify you personally.

Fulcrum Audio does not sell or rent our customers’ personal information to any other party. However, in the normal course of business we may share some of your personal information within our corporate family and with third parties acting on our behalf or as permitted or required by law.

Other than information displayed as part of your profile, as a general rule, we will not disclose any of your personally identifiable information except when we have your permission or under special circumstances, such as when we believe in good faith that the law requires it or under the circumstances described below. We may disclose account information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our Terms of Service or may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other users of the Web Site or anyone else that could be harmed by such activities. Certain features at the Web Site, including but not limited to video uploads, are outsourced to partner sites. If you wish to access these features, your registration information will be submitted to the relevant partner site in order to open an account on your behalf. This new account is necessary to manage content posted by your account at the Web Site, as such content will be managed off-site.

Any information we have about you may be transferred or disclosed to a purchaser or prospective purchaser in the event of a sale, assignment, or other transfer of all or a portion of our business or assets. Fulcrum Audio may use third parties to manage one of more aspects of our business operations, including the processing or handing of personal information. For example, we may share personal information with third parties to perform services on our behalf such as: fulfilling online orders, processing non-cash payments, sending marketing communications, servicing products, conducting research surveys, verifying and validating information that you have provided to us, delivering products, and providing customer support services.

For example, we may be compelled to release information by a court of law or other person or entity with jurisdiction to compel production of such information. Fulcrum Audio has adopted industry standard authentication procedures to ensure your protection while shopping with us online. This includes, but is not limited to, contacting financial institutions or credit reporting agencies to ensure the authenticity of your credit card and to validate your credit card billing information.

Choosing a Password

When you create an online account on our Web Site, you need to select a personal password. We keep your information only as long as we need it for legitimate business purposes and to meet any legal requirements. We have retention standards that meet these parameters. We destroy your information when it is no longer needed, or we remove your personally identifiable information to render it anonymous.

We collect your personal information onto servers hosted by us, which are restricted access servers. We do not store credit/debit or Paypal related information on our servers. Fulcrum is 100% opposed to unsolicited commercial email ("spam"). We do not send emails to anyone without permission and we do not sell or provide email addresses to any unauthorized third party. If you receive any unsolicited emails from spammers, please be assured that Fulcrum did not provide your email address to such parties.

This does not mean that we can prevent spam from happening on the Internet. Unfortunately, spammers obtain email addresses in a number of devious ways, including when you respond and ask to be taken off a spam email list and in some cases by just generating emails to millions of random email addresses in the hopes of getting a few "live" ones. Please be assured that at Fulcrum we hate spam as much as you do.
